The administratrix of James F. Coburns estate sued the trustee of the St. Louis Southwestern Railway Company (commonly known as the "Cottonbelt") under the Federal Employers Liability Act, § 1 et seq., 45 U.S.C.A. § 51 et seq., for negligence causing Coburns death. The defense was a denial of negligence and a charge that the death was due solely to Coburns own lack of care, failure to perform his duties and violation of company rules. The jury returned a verdict for the plaintiff, on which the court entered judgment, and the trustee has appealed.
